Owned vs. rented audience

OK. Here’s the uncomfortable part. Your social media followers are rented. The platform decides who sees your posts, changes the rules whenever it wants, and can suspend your account without much of an explanation. Your email list is owned. You have the contact, you have permission, and you decide when to show up in their inbox.

That doesn’t make social media pointless. We do social media management too. It just means the list is the asset you control, and it deserves at least as much attention as your follower count.

Deliverability and the rules you have to follow

Gmail and Yahoo sender requirements

Since 2024, Gmail’s sender guidelines and Yahoo’s sender requirements set a baseline for everyone who sends email to their users:

  • All senders need SPF or DKIM authentication, valid DNS records for sending servers, and a spam complaint rate below 0.3%.
  • Bulk senders (Gmail defines this as sending 5,000 or more messages a day to Gmail accounts) also need both SPF and DKIM, a DMARC policy, a From domain that aligns with SPF or DKIM, one-click unsubscribe for marketing messages, and a visible unsubscribe link in the body. Yahoo asks bulk senders to honor unsubscribes within two days.

Even if you’re nowhere near 5,000 a day, following the bulk-sender standard is the sensible default. It’s what keeps you out of the spam folder.

CAN-SPAM

The federal CAN-SPAM Act applies to commercial email, including business-to-business email. The FTC’s compliance guide lists the basics: accurate header and “from” information, subject lines that aren’t deceptive, identifying the message as an ad where required, including a valid physical postal address, a clear way to opt out, and honoring opt-outs within 10 business days. It also notes that you remain responsible even if you hire someone else to send your email. We build all of that into every template.

A note for healthcare and mental health practices

If you’re a medical, chiropractic, or mental health practice, be careful with what goes in an email, not just who it goes to. HIPAA’s marketing rules generally require written authorization before using protected health information for marketing, with exceptions such as communications about your own health-related services and treatment-related communications. Practically, we keep marketing emails general (no diagnoses, treatments or appointment details in the content), use segments that don’t reveal health conditions, and talk with you about whether your email platform needs a business associate agreement. There’s no official “HIPAA certification” for an email tool or an agency, so be wary of anyone selling one.

Why open rates aren't the number to watch

Apple’s Mail Privacy Protection downloads remote content “privately in the background when you receive a message (instead of when you view it)” and hides when and how many times someone views it. Since open tracking depends on that remote content loading, many Apple Mail users show as “opened” whether they read the email or not. Open rates still move, they just don’t tell you much.

Our list is old. Can we still use it?

Usually, carefully. We clean it first and start with the people most likely to remember you, like recent clients, before reaching further back. Mailing an old list all at once is how deliverability gets damaged.

How often should we send?

Often enough that people remember you, rarely enough that each email has a point. For many small businesses that’s monthly or twice a month, plus automated sequences running in the background.

Do you do HIPAA-compliant email?

We follow a cautious approach for healthcare clients: general content, no protected health information in marketing email, and a discussion about whether your platform needs a business associate agreement. Your practice is responsible for its HIPAA compliance, and there’s no official HIPAA certification for vendors.

Who owns the list and the email account?

You do. The list, the sending domain and the platform account belong to your business. We work inside them.

Can you use the CRM we already have?

Often, yes. If your current tool can handle segmentation, automation and proper unsubscribe handling, we’ll work with it. If not, we’ll explain why and what we’d suggest instead.
